CONFIDENTIALITY OF RECORDS RELATING TO THE HUMAN IMMUNODEFICIENCY VIRUS (HIV) OR ACQUIRED IMMUNE DEFICIENCY SYNDROME (AIDS)
Acquired Immune Deficiency Syndrome (AIDS) is a condition that is caused by infection with the Human Immunodeficiency Virus (HIV). The Human Immunodeficiency Virus damages the immune system and eventually destroys the body’s ability to fight infection and disease. People infected with the Human Immunodeficiency Virus are diagnosed as having AIDS if and when they develop one of 26 opportunistic diseases or infections listed by the Centers For Disease Control and Prevention (CDC) or if their T-cell count (one of the white blood cells that make up our immune system) falls below 200 per measured amount of blood. AIDS is the end stage of Human Immunodeficiency Virus infection.
Due to advances in medicine and medical treatment for HIV and AIDS, some infected children, who in the past would have died prior to reaching school age, are entering our schools. In accordance with The Health Insurance Portability and Accountability Act of 1996 (HIPAA) Privacy and Security Rules records (Florida Statute 384.29) dealing with HIV or AIDS must be kept confidential. All health records, notes, and other documents that reference a person’s HIV/AIDS status will be kept under lock and key. Information regarding student’s permanent educational or health record without written consent of the student’s natural parent(s) or legal guardian(s).
Every employee has a duty to treat as highly confidential any knowledge or speculation concerning the HIV status of a student or other staff member. Violation of medical privacy is cause for disciplinary action, and/or personal liability for a civil suit.
